What Information Helps Us Locate a Recording
Texas law requires a written request for body-worn camera video to include specific information. To help us locate the correct recording, please provide:
- Date and approximate time of the recording
- Specific location where the recording occurred
- Name of one or more persons known to be a subject of the recording
If the request does not include enough information to locate the recording, we may contact you for clarification. Providing complete information helps prevent delay in processing the request.
The following principles guide how we handle requests:
Recordings Are Not Automatically Public
Body-worn camera recordings are reviewed under Texas Code of Criminal Procedure Art. 2B.0112 and related confidentiality laws. Some recordings may be withheld, redacted, or released only in part.
Attorney General Review
When required by law, the department may request a decision from the Texas Attorney General before withholding requested body-worn camera information.
Private Spaces & Sensitive Situations
The department may not release portions of a recording made in a private space, or involving a fine-only misdemeanor investigation that did not result in arrest, without written authorization from the civilian subject of that portion of the recording or, if deceased, the subject’s authorized representative.
Criminal Evidence and Investigations
Recordings that are or could be used as evidence in a criminal prosecution may be subject to the Texas Public Information Act, applicable exceptions, redactions, and Attorney General review when required.
Fees
Fees may apply for reviewing and providing a copy of a body-worn camera recording.
Recordings Not Required by Law or Policy
A recording may be confidential if it was not required to be made under law or department policy and does not relate to a law-enforcement purpose.
